If you are the freehold owner, did you know that you can close your business down any time you like but you cannot alter the trading areas without planning consent? This may sound ridiculous especially as you will probably be living over the trading areas but you cannot change the trading areas or live in them without permission for a change of use.

My advice may be for a partial Change of Use whereby the pub is made smaller and easier to manage or there might be an opportunity to convert disused rooms or outbuildings into residential dwellings so that equity can be released by selling on the development opportunity or even carrying it out yourself. Sometimes the pub has reached the end of its life and become defunct whereby the only solution is for a complete Change of Use although this only occurs in around 30% of the cases we handle.

There are usually four main issues to address from within the Local Authority Policies relating to the loss of a community facility.

  1. Viability - is the pub consistently making a loss?
  2. Marketing - has the pub been on the open market recently?
  3. Alternative Community Use - could the pub be retained if another community facility was combined with the pub use or would the entire building suit an alternative community use?
  4. Pubs nearby - is there an alternative similar facility within walking distance?

By the way, if you own a pub which is currently successful and you are merely just looking for a quick profit from a development, there is little chance that you will be granted a Change-of-Use and we would probably not accept your instruction.

Change-of-use is not rocket science but one needs to understand the opinions of the planners and those objectors who appear out of the woodwork claiming that they have been using the pub for years when, in fact, you have probably never taken a penny off them. Most other Change-of-Use reports we have researched only look at the national trend in closures and at the non-viability of the business. Viability is a key issue but we have learned to thoroughly examine every aspect of the individual pub in question such as its trading history, calibre of past & present landlords, nearby competition, possible alternative community use, residents’ opinions to name but a few of the points we may address in detail.
